Hamburg, June 2, 2025 – The Hamburg public prosecutor's office has brought charges before the regional court against those responsible at the alanta health group GmbH. The allegations focus on the alleged unlawfulness of the patient care model.

The company has issued the following statement on this matter:

“Our top priority is to provide high-quality care to all patients, which has always been guaranteed and will continue to be safeguarded. The outstanding quality of the cancer medications has never been questioned by the public prosecutor's office and is regularly monitored by the competent health authorities. The patients can trust the quality of our services. Their medical care is always provided in accordance with guidelines and high ethical standards. All services have always been provided flawlessly.

1. The company and its management are convinced that the medical care centres (MVZ) model practiced within the alanta group meets all legal requirements. The ownership structure of these MVZs has been handled transparently at all times, both towards the competent bodies and authorities and towards the public. The legal opinion on which the authorities' allegations are based is clearly refuted by detailed expert legal advice; moreover, it contradicts the intended and actual reality of care provision in oncology in Germany. Patient care via MVZ is a cornerstone of outpatient care and is preferred by healthcare bodies. In Germany, there are now over 4,500 MVZs operating in various medical disciplines and under different owners. Their establishment and operation is fully compliant with applicable laws. All MVZs belonging to the Group have been granted permanent authorization in line with the appropriate legal processes.
2. The public prosecutor's office accuses those responsible at alanta health of circumventing the legal ban on cooperation between pharmaceutical service providers and contract physicians. We firmly reject this; this accusation is unfounded. All alanta MVZ are completely independent in medical matters. At no point was the legally guaranteed freedom of therapy interfered with; it was always respected to the highest degree. The MVZ of alanta and their physicians provide daily care to seriously ill patients and perform professional work of outstanding quality. This is not disputed by the public prosecutor's office.
3. We also firmly reject the accusation that services were not invoiced correctly. All cancer medications were provided without fault and in high quality, they were prescribed by a physician and were properly invoiced to the health insurance companies. The stated amount of damages is based on a formal interpretation of the extended concept of damage in German Social Law and does not represent any material damage.
   

We are convinced that the allegations are unfounded and will be comprehensively refuted during the proceedings.”
